Froogle Online Ordering Privacy Policy and Terms of Use

Effective date: 1/01/2020

These policies and terms apply to the online ordering websites and restaurant ordering stores operated through technology provided by Froogle, Inc. (“Froogle,” “we,” “us,” or “our”).

They explain how information is handled and the terms that apply when you use our online ordering service. They do not describe separate features of the Froogle mobile application unless those features link to and expressly adopt these policies.

Part 1: Privacy Policy

1. Information We Collect

When you use our online ordering service, we collect information you provide, which may include:

  • Your name.
  • Email address and telephone number.
  • Delivery address, when delivery is requested.
  • Order selections, special instructions, and order history.
  • Information you provide when contacting customer support.

Our systems may also collect technical information associated with your use of the service, such as your IP address, browser and device information, access times, and pages visited.

Please do not include payment card details or other sensitive information in order instructions or support messages.

2. How We Use Information

We use customer information to:

  • Transmit orders to the selected restaurant.
  • Enable the restaurant to prepare and fulfill orders.
  • Provide order confirmations and order-related communications.
  • Maintain order records and customer accounts, where available.
  • Respond to questions and provide technical support.
  • Investigate errors, suspected fraud, and unauthorized activity.
  • Maintain, secure, and improve the ordering service.
  • Meet applicable legal and recordkeeping obligations.

3. Storage and Access

Customer contact information and order records are stored in Froogle’s backend systems. Authorized Froogle personnel can access this information through our back office for the purposes described in this policy.

The selected restaurant receives the information needed to process and fulfill your order. Depending on your order, this may include your name, contact information, delivery address, order items, and special instructions.

4. Payment Information

Payments are processed through the selected restaurant’s payment provider. Froogle does not store or have access to your payment card details.

The restaurant receives its food and beverage order proceeds directly through its payment arrangements. Froogle receives a convenience fee for providing the online ordering technology.

Payment providers handle payment information under their own privacy policies and security practices.

5. When Information Is Disclosed

We do not sell your personal information.

We disclose customer information to the restaurant you select so that it can process and fulfill your order.

Service providers that help operate, host, secure, or support the ordering service may handle information as needed to provide those services.

We may also disclose information:

  • When required by law or a valid legal request.
  • To investigate fraud, security incidents, or misuse of the service.
  • To protect the rights, property, or safety of customers, restaurants, Froogle, or others.
  • In connection with a merger, acquisition, or transfer of the business, subject to applicable law.
  • At your direction or with your consent.

6. Cookies and Similar Technologies

The ordering service may use cookies or similar technologies to maintain your session, remember ordering selections, support account features, and help the service function securely.

You can manage cookies through your browser settings. Blocking certain cookies may prevent parts of the ordering service from working properly.

Any additional use of analytics or advertising technologies must be disclosed as applicable, with choices or consent mechanisms provided where required by law.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the service and fulfill the purposes described in this policy, including maintaining transaction records, resolving disputes, preventing fraud, and meeting legal obligations.

Retention periods depend on the type of information and the reason it is maintained. Information may remain in protected backups until those backups are replaced or deleted through our normal processes.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect customer information against unauthorized access, disclosure, alteration, and loss.

No internet transmission or electronic storage system can be guaranteed completely secure.

If you have an account, you are responsible for protecting your login credentials and notifying us of suspected unauthorized use.

9. Your Choices and Privacy Requests

You may contact us at customerservice@froogleapp.com to ask about your personal information or request access, correction, or deletion.

Depending on where you live and which laws apply, you may have additional privacy rights, including rights to obtain a copy of your information or appeal a decision regarding a privacy request.

We may need to verify your identity before acting on a request. Some information may need to be retained for legal, security, transaction recordkeeping, or dispute-resolution purposes.

Restaurants and payment providers may maintain their own records. Requests concerning records held independently by those businesses should also be directed to them.

10. Children’s Privacy

The ordering service is not directed to children under 13. We do not knowingly collect personal information from children under 13.

If you believe a child under 13 has provided personal information through the service, contact customerservice@froogleapp.com so we can investigate and take appropriate action.

11. Other Websites and Services

Restaurant websites, payment providers, delivery providers, and other linked services may have their own privacy policies. Their independent collection and use of information are governed by their policies.

12. Changes to This Privacy Policy

We may update this policy as our services or practices change. The current version will be posted with an updated effective date. We will provide additional notice or obtain consent when required by applicable law.

13. Privacy Contact

Part 2: Online Ordering Terms of Use

1. Acceptance of These Terms

These terms govern your use of Froogle’s online ordering technology. By submitting an order, you agree to these terms and any restaurant-specific terms clearly disclosed before you submit the order.

If you do not agree, do not submit an order through the service.

2. Froogle’s Role

Froogle provides technology that allows customers to place online orders with participating restaurants.

Your purchase of food and beverages is from the selected restaurant. The restaurant is responsible for its menu, pricing, product descriptions, order acceptance, food preparation, food safety, and fulfillment.

Froogle receives a convenience fee for providing the online ordering service. Froogle does not receive or hold the restaurant’s food and beverage order proceeds.

Nothing in these terms excludes responsibilities that applicable law places on Froogle.

3. Customer Information and Order Accuracy

You are responsible for reviewing your order before submitting it and providing accurate contact information, delivery details, and pickup selections.

Please verify the restaurant location, menu selections, quantities, requested time, and total price before paying.

Do not submit fraudulent orders, use payment methods without authorization, or interfere with the ordering service.

4. Order Acceptance and Availability

Submitting an order or receiving an automated confirmation does not necessarily mean the restaurant has accepted the order.

Orders are subject to restaurant acceptance, operating hours, item availability, and the restaurant’s ability to fulfill the request.

If an item is unavailable or an order cannot be fulfilled, the restaurant may contact you about an adjustment, substitution, or cancellation. Changes that increase your charge require your authorization.

5. Prices, Taxes, and Convenience Fees

Review the displayed pricing and order summary before submitting payment.

Applicable taxes and fees will be identified as required by law. Froogle receives the convenience fee identified for use of the online ordering service.

Online prices and availability may differ from those offered through other ordering channels.

Fees and prices must be displayed in accordance with applicable law. Disclosure in these terms does not replace required disclosures on menus, ordering pages, or checkout screens.

6. Payments

You authorize the restaurant’s payment provider to charge your selected payment method for the total you approve at checkout.

Restaurant order proceeds are deposited directly through the restaurant’s payment arrangements. Froogle receives its convenience fee through the applicable fee arrangements.

Froogle does not store or have access to your payment card details.

7. Cancellations, Refunds, and Order Problems

Contact the restaurant promptly about order changes, cancellations, missing items, incorrect items, food quality, or other fulfillment issues. Use the contact information shown on the restaurant’s ordering page or order confirmation.

Once preparation has begun, the restaurant may be unable to change or cancel an order.

The restaurant handles refunds for restaurant purchases through its payment provider, subject to applicable law.

If the restaurant rejects or cancels an order before fulfillment, amounts charged for the unfulfilled order, including Froogle’s convenience fee, will be refunded. For other adjustments or partial refunds, treatment of the convenience fee will be disclosed when the refund is arranged and will comply with applicable law.

Refund posting times depend on the payment provider and your financial institution.

Nothing in these terms limits refund rights or payment dispute rights available under applicable law.

For technical problems or questions about Froogle’s convenience fee, contact customerservice@froogleapp.com.

8. Pickup and Delivery

Pickup and delivery times are estimates unless expressly stated otherwise. Preparation time, order volume, traffic, weather, and other conditions may affect fulfillment.

For pickup orders, confirm the correct restaurant location and follow the restaurant’s pickup instructions.

For delivery orders, provide an accurate address, contact number, and necessary access instructions. Delivery availability and responsibility will be by the restaurant or 3rd party ordering service.

Froogle’s provision of ordering technology does not, by itself, mean Froogle prepares or delivers the order.

9. Allergies and Dietary Requirements

Contact the restaurant directly before ordering if you have a food allergy or dietary restriction.

An order note alone does not confirm that a restaurant can accommodate an allergy or prevent cross-contact. Froogle does not prepare food or independently verify ingredients or restaurant preparation practices.

10. Accounts and Service Security

If account features are available, provide accurate information and protect your account credentials.

We may restrict access when reasonably necessary to address suspected fraud, unauthorized activity, security threats, or misuse of the service.

11. Service Availability and Responsibility

We work to maintain the ordering service, but interruptions, technical errors, or temporary unavailability may occur.

Contact the restaurant if you are unsure whether an order was received before submitting a duplicate order.

Each party remains responsible for its own obligations under applicable law. These terms do not exclude liability or waive consumer rights that cannot lawfully be excluded or waived.

12. Changes to These Terms

We may update these terms by posting a revised version with a new effective date. Updated terms apply to orders submitted after the changes take effect and do not retroactively change completed orders.

We will provide additional notice when required by applicable law.

13. Contact Information

For restaurant purchases, fulfillment issues, or food-related concerns, contact the restaurant shown on your order confirmation.
